Hearing the appeal of present set up of office bearers of The Kashmir Chamber of Commerce & Industry (KCC&I) against the order of 4th Additional District Judge, Srinagar, restraining the office bearers from taking any decision with regard to KCC&I ,the Hon’ble Justice A.M.Magray expressed anguish and displeasure over the dithering attitude of office bearers of KCC&I over the issue of holding elections to 21 Member Executive Committee.
The court in its order said that the restraining order of Learned 4th Additional District Judge passed on 2nd September, 2020 shall continue to hold the field and be operative. The court observed that keeping the stature, respect and reputation of KCCI and most of its members in mind the Court through a proposal tried to find an amicable way out for holding the election. It had perceived that the parties to the appeal were genuinely interested in holding the elections.
However, the Hon’ble Judge lamented that while claimant- respondents were prepared to go by the efforts of the court the defendant-respondents (office bearers) demonstrated a dithering attitude. In the circumstances the court observed that it will pass an order on the appeal. The court said that it will be distasteful to narrate what all happened and transpired during this period. It will be suffice to say that court failed in its efforts. (CNS)
